TRANSPORT AND DELIVERY LIABILITY POLICY NEXT GENETICS ONLINE --- 1. DEFINITIONS 1.1 “Transport” means the movement of goods, livestock, or genetic material from Seller to Buyer. 1.2 “Buyer” means the purchaser of goods or services. 1.3 “Seller” means the provider of goods or services. 1.4 “Transport Provider” means any party responsible for delivery, including: * The Seller * The Buyer * A third-party logistics provider 1.5 “Platform” means NEXT GENETICS DORPERS (PTY) LTD TA NEXT GENetics online, including all subdomains. --- 2. ROLE OF THE PLATFORM 2.1 The Platform facilitates connections between Buyers and Sellers. 2.2 The Platform does NOT: * Provide transport services * Act as a carrier or logistics provider * Assume responsibility for delivery 2.3 The Platform is not a party to any transport agreement. --- 3. TRANSPORT ARRANGEMENTS 3.1 Transport arrangements are made directly between: * Buyer and Seller; or * Buyer and a third-party Transport Provider 3.2 Sellers may offer transport services as part of a listing. 3.3 Acceptance of such transport forms a separate agreement between the parties. --- 4. COST OF TRANSPORT 4.1 Unless otherwise agreed: * Transport costs are borne by the Buyer 4.2 All pricing and terms must be clearly agreed between parties. --- 5. RISK AND TRANSFER OF LIABILITY 5.1 Risk in goods transfers: * As agreed between Buyer and Seller; or * In the absence of agreement, upon handover to the Transport Provider 5.2 Once risk has transferred: * The Buyer assumes all responsibility 5.3 The Platform bears no risk at any stage. --- 6. SELLER-PROVIDED TRANSPORT 6.1 Where the Seller provides transport: * The Seller assumes responsibility for delivery * The Seller is liable for loss or damage until delivery (unless otherwise agreed) 6.2 The Platform is not liable for: * Seller negligence * Transport failures * Delivery delays --- 7. THIRD-PARTY TRANSPORT PROVIDERS 7.1 Where third-party logistics providers are used: * They act independently of the Platform 7.2 The Platform is not responsible for: * Conduct of transport providers * Loss, damage, or delay * Breach of transport agreements --- 8. LIVESTOCK-SPECIFIC RISKS 8.1 Transport of livestock involves inherent risks, including: * Injury * Disease transmission * Stress-related conditions * Death 8.2 Buyers accept these risks upon transfer of liability. 8.3 The Platform makes no warranties regarding: * Condition during transport * Survival * Fitness for purpose --- 9. COMPLIANCE WITH LAWS 9.1 Users must comply with all applicable laws, including: * Animal welfare legislation * Transport regulations * Biosecurity requirements 9.2 The Platform is not responsible for compliance failures. --- 10. INSURANCE 10.1 Users are responsible for obtaining: * Transport insurance * Livestock insurance (if required) 10.2 The Platform does not provide insurance. --- 11. DELIVERY CONFIRMATION 11.1 Delivery confirmation may be required for: * Escrow release * Transaction completion 11.2 Disputes regarding delivery must be resolved between Buyer and Seller. --- 12. DISPUTES 12.1 Transport-related disputes are the responsibility of: * Buyer and Seller; or * Buyer and Transport Provider 12.2 The Platform may assist but is not obligated to intervene. --- 13. LIMITATION OF LIABILITY 13.1 To the maximum extent permitted by law, the Platform shall NOT be liable for: * Loss or damage during transport * Livestock injury or death * Delays in delivery * Third-party conduct 13.2 All transport risks are assumed by Users. --- 14. INDEMNITY 14.1 Users indemnify NEXT GENETICS DORPERS (PTY) LTD against: * Claims arising from transport * Loss or damage of goods * Regulatory breaches * Third-party claims --- 15. FORCE MAJEURE The Platform is not liable for transport failures caused by: * Weather conditions * Road conditions * Natural disasters * External disruptions --- 16. GOVERNING LAW This Policy is governed by the laws of the Republic of South Africa. --- 17.
