REFUND POLICY
REFUND POLICY NEXT GENETICS ONLINE --- 1. INTRODUCTION 1.1 This Refund Policy governs refunds for transactions conducted on the NEXT GENETICS DORPERS (PTY) LTD (“Online”, “Platform”). 1.2 This Policy must be read together with: * Terms and Conditions * Escrow Policy * Auction Rulebook * CPA & ECT Compliance Policy --- 2. PLATFORM ROLE 2.1 The Platform operates as an **intermediary marketplace**. 2.2 The Platform is NOT: * The seller of goods * A party to transactions * Responsible for fulfilment of sales 2.3 Refund obligations rest primarily with the Seller. --- 3. GENERAL REFUND PRINCIPLE 3.1 Refunds are NOT automatic. 3.2 Refunds are determined based on: * Agreement between Buyer and Seller * Applicable law (including CPA where applicable) * Nature of the transaction --- 4. NON-REFUNDABLE TRANSACTIONS 4.1 The following transactions are generally **non-refundable**: * Auction purchases * Livestock purchases * Genetic material (e.g., semen, embryos) * Perishable goods * Custom or specially arranged services 4.2 Buyers acknowledge that such transactions carry inherent risk. --- 5. ELIGIBLE REFUND SCENARIOS Refunds may be considered in the following cases: 5.1 **Non-Delivery** * Seller fails to deliver goods 5.2 **Proven Misrepresentation** * Material facts were falsely stated * Goods differ substantially from description 5.3 **Duplicate or Erroneous Payment** * Payment processed incorrectly 5.4 **Failed Transactions** * Payment completed but transaction not fulfilled --- 6. LIVESTOCK AND GENETICS EXCLUSIONS 6.1 Refunds will NOT be granted for: * Disease after sale * Mortality after transfer of risk * Failure of breeding or fertility * Performance expectations 6.2 Buyers accept all biological and environmental risks. --- 7. AUCTION PURCHASES 7.1 All auction bids are: * Binding * Irrevocable 7.2 Refunds are NOT available for: * Buyer remorse * Pricing dissatisfaction * Failure to conduct due diligence --- 8. ESCROW-RELATED REFUNDS 8.1 Where funds are held in escrow: * Refunds may be processed before release 8.2 Refund outcomes may include: * Full refund to Buyer * Partial refund * Release to Seller 8.3 The Platform may act based on: * Evidence provided * System rules * Risk assessment --- 9. REFUND PROCESS 9.1 To request a refund, the Buyer must: * Submit a written request * Provide supporting evidence 9.2 The Platform may: * Review the request * Request additional documentation * Facilitate communication between parties 9.3 The Platform is not obligated to resolve disputes. --- 10. PAYMENT PROVIDERS 10.1 Refunds are processed via: * PayFast * Ozow 10.2 Processing times depend on: * Payment provider * Banking systems 10.3 The Platform is not responsible for: * Delays in refund processing * Provider-related issues --- 11. CHARGEBACKS 11.1 Buyers may initiate chargebacks through their payment provider. 11.2 The Platform may: * Contest chargebacks * Recover funds from Sellers * Suspend accounts --- 12. FRAUD AND ABUSE 12.1 Refund requests may be denied where: * Fraud is suspected * Abuse of refund processes is detected 12.2 The Platform may take enforcement action. --- 13. LIMITATION OF LIABILITY 13.1 To the maximum extent permitted by law, the Platform shall NOT be liable for: * Refund disputes * Losses arising from transactions * Indirect or consequential damages --- 14. INDEMNITY 14.1 Users indemnify NEXT GENETICS DORPERS (PTY) LTD against: * Refund-related claims * Disputes between Buyers and Sellers * Third-party claims --- 15. CPA COMPLIANCE 15.1 Where required by law: * Consumer rights under the CPA will be respected 15.2 However, users acknowledge that: * Many transactions fall outside CPA refund protections --- 16. AMENDMENTS 16.1 This Policy may be updated at any time. 16.2 Continued use constitutes acceptance of changes. --- 17. GOVERNING LAW This Policy is governed by the laws of the Republic of South Africa. --- 18.
