LIVESTOCK AND GENETICS LIABILITY DISCLAIMER POLICY NEXT GENETICS ONLINE --- 1. DEFINITIONS 1.1 “Livestock” includes all animals traded on the Platform, including but not limited to cattle, sheep, goats, and other farm animals. 1.2 “Genetic Material” includes semen, embryos, and any reproductive material. 1.3 “Buyer” means the purchaser of Livestock or Genetic Material. 1.4 “Seller” means the party offering Livestock or Genetic Material for sale. 1.5 “Platform” means NEXT GENetics online, including all subdomains. --- 2. NATURE OF PLATFORM 2.1 The Platform operates as an intermediary marketplace. 2.2 The Platform does NOT: * Own any Livestock or Genetic Material * Act as a breeder, veterinarian, or supplier * Participate in Transactions 2.3 All Transactions occur directly between Buyer and Seller. --- 3. “AS IS” SALE 3.1 All Livestock and Genetic Material are sold: * “As is” * “As available” 3.2 No warranties are given by the Platform regarding: * Health * Condition * Genetic quality * Fertility * Performance --- 4. NO WARRANTIES BY PLATFORM 4.1 The Platform makes NO representations or warranties regarding: * Accuracy of listings * Veterinary condition * Genetic traits * Disease status 4.2 Any warranties must be expressly provided by the Seller. --- 5. BUYER DUE DILIGENCE 5.1 Buyers are solely responsible for: * Inspecting Livestock * Verifying information * Obtaining veterinary advice * Conducting independent assessments 5.2 Failure to conduct due diligence does NOT invalidate the sale. --- 6. DISEASE AND HEALTH RISKS 6.1 Livestock may carry inherent risks, including: * Disease * Infection * Parasites * Undiagnosed conditions 6.2 Buyers assume all such risks upon completion of the Transaction or transfer of risk. 6.3 The Platform is not liable for: * Disease transmission * Post-sale illness * Mortality --- 7. GENETIC MATERIAL DISCLAIMER 7.1 Genetic Material is sold without guarantees regarding: * Fertility * Conception success * Genetic outcomes * Performance traits 7.2 Environmental and biological factors may affect results. 7.3 The Platform accepts no liability for unsuccessful outcomes. --- 8. VETERINARY AND PROFESSIONAL SERVICES 8.1 The Platform does NOT provide: * Veterinary services * Breeding advice * Genetic consultation 8.2 Users must obtain independent professional advice where required. --- 9. TRANSPORT RISKS 9.1 Livestock transport carries risks, including: * Injury * Stress * Death 9.2 Risk transfers in accordance with the Transport Policy. 9.3 The Platform is not liable for any transport-related outcomes. --- 10. COMPLIANCE WITH LAWS 10.1 Users must comply with: * Animal Protection Act * Veterinary regulations * Biosecurity requirements 10.2 The Platform is not responsible for: * Legal non-compliance * Regulatory breaches --- 11. SELLER RESPONSIBILITIES 11.1 Sellers must: * Provide accurate information * Disclose known defects * Comply with applicable laws 11.2 Misrepresentation may result in: * Suspension * Account termination * Legal reporting --- 12. LIMITATION OF LIABILITY 12.1 To the maximum extent permitted by law, the Platform shall NOT be liable for: * Loss of Livestock * Death or injury of animals * Genetic defects * Failed breeding outcomes * Financial losses 12.2 Liability is excluded even where loss is foreseeable. --- 13. INDEMNITY 13.1 Users indemnify NEXT GENetics online against: * Claims arising from Livestock transactions * Disease-related claims * Veterinary claims * Third-party claims --- 14. ASSUMPTION OF RISK 14.1 Buyers expressly acknowledge and accept that: * Livestock trading involves inherent risks * Genetic outcomes cannot be guaranteed 14.2 All risks are assumed by the Buyer. --- 15. DISPUTES 15.1 Disputes relating to Livestock or Genetic Material must be resolved between: * Buyer and Seller 15.2 The Platform may assist but is not obligated to intervene. --- 16. RECORDS 16.1 Platform records of listings and transactions are: * Final * Binding * Admissible as evidence --- 17. GOVERNING LAW This Policy is governed by the laws of the Republic of South Africa. --- 18.
