FRAUD ENFORCEMENT
FRAUD PREVENTION AND ENFORCEMENT POLICY NEXT GENETICS PLATFORM --- 1. DEFINITIONS 1.1 “Fraud” means any act of deception intended to secure unfair or unlawful gain. 1.2 “User” means any registered individual or entity on the Platform. 1.3 “Suspicious Activity” means any activity reasonably believed to indicate fraud, abuse, or unlawful conduct. 1.4 “Platform” means NEXT GENetics, including all subdomains and services. --- 2. PURPOSE 2.1 This Policy establishes the framework for: * Detecting fraud * Preventing abuse * Enforcing compliance * Protecting users and the Platform 2.2 This Policy forms part of the Platform’s Terms and Conditions. --- 3. PROHIBITED CONDUCT Users are strictly prohibited from engaging in: 3.1 **Misrepresentation** * False descriptions of livestock, products, or services * Misleading information regarding health, genetics, or ownership 3.2 **Auction Manipulation** * Bid rigging * Artificial price inflation * Self-bidding or collusion 3.3 **Payment Fraud** * Chargeback abuse * Use of stolen payment methods * Payment reversal schemes 3.4 **Identity Fraud** * Use of false identities * Submission of fraudulent documentation 3.5 **Platform Abuse** * Circumventing platform systems * Exploiting bugs or vulnerabilities * Unauthorized API usage 3.6 **Communication Abuse** * Attempting to bypass platform safeguards * Off-platform deal manipulation to avoid commission --- 4. MONITORING AND DETECTION 4.1 The Platform reserves the right to monitor: * Transactions * Auction activity * User communications * API usage 4.2 Monitoring may be: * Automated (algorithms, fraud detection systems) * Manual (administrative review) 4.3 Users expressly consent to such monitoring. --- 5. INVESTIGATION PROCESS 5.1 Upon detection of Suspicious Activity, the Platform may: * Flag the account * Temporarily restrict access * Request additional verification * Freeze associated funds 5.2 Users may be required to provide: * Identification documents * Transaction evidence * Supporting records 5.3 Failure to cooperate may result in enforcement action. --- 6. ENFORCEMENT ACTIONS 6.1 The Platform may take one or more of the following actions: * Issue warnings * Suspend accounts * Permanently ban users * Remove listings * Cancel auctions * Reverse transactions (where possible) 6.2 Enforcement actions may be taken: * Without prior notice * At the Platform’s sole discretion --- 7. FUND WITHHOLDING 7.1 The Platform may withhold funds where: * Fraud is suspected * A dispute exists * Regulatory compliance requires it 7.2 Withheld funds may be: * Frozen pending investigation * Released based on outcome * Returned to payer where appropriate --- 8. REPORTING TO AUTHORITIES 8.1 The Platform reserves the right to report: * Fraudulent activity * Suspicious transactions * Identity misuse To: * Law enforcement * Regulatory authorities 8.2 The Platform may provide: * User data * Transaction records * Communication logs Where legally required. --- 9. USER RESPONSIBILITIES Users must: 9.1 Act honestly and in good faith 9.2 Provide accurate information 9.3 Maintain account security 9.4 Report suspicious activity --- 10. NO LIABILITY FOR ENFORCEMENT 10.1 The Platform shall NOT be liable for: * Losses resulting from enforcement actions * Account suspension or termination * Withheld or delayed funds 10.2 All enforcement actions are taken: * In good faith * For the protection of the Platform and its users --- 11. APPEALS PROCESS 11.1 Users may submit an appeal against enforcement actions. 11.2 Appeals must: * Be submitted in writing * Include supporting evidence 11.3 The Platform may: * Uphold the decision * Modify the action * Reinstate the account 11.4 All decisions are final unless required otherwise by law. --- 12. LIMITATION OF LIABILITY 12.1 To the maximum extent permitted by law, the Platform shall NOT be liable for: * Fraud committed by users * Losses arising from transactions * Indirect or consequential damages --- 13. INDEMNITY 13.1 Users indemnify and hold harmless NEXT GENetics against: * Claims arising from fraudulent conduct * Regulatory penalties caused by user actions * Third-party claims --- 14. DATA PROCESSING 14.1 Fraud detection may involve processing personal data in accordance with POPIA. 14.2 Data may be shared with: * Payment providers * Fraud prevention services * Authorities --- 15. AMENDMENTS 15.1 The Platform reserves the right to amend this Policy at any time. 15.2 Continued use constitutes acceptance of updates. --- 16. GOVERNING LAW This Policy is governed by the laws of the Republic of South Africa. --- 17.
