ANIMAL HEALTH AND BIOSECURITY DISCLAIMER NEXT GENETICS ONLINE --- 1. INTRODUCTION 1.1 This Animal Health and Biosecurity Disclaimer (“Disclaimer”) applies to all transactions involving livestock and related biological material on the NEXT GENETICS DORPERS (PTY) LTD (“online”, “Platform”). 1.2 This Disclaimer must be read together with: * Master Terms and Conditions * Livestock and Genetics Liability Policy * Transport Policy --- 2. PLATFORM ROLE 2.1 The Platform operates solely as an intermediary marketplace. 2.2 The Platform does NOT: * Own livestock * Act as a veterinarian or animal health authority * Provide health certifications * Inspect animals 2.3 All responsibility for animal health lies with Users. --- 3. NO HEALTH WARRANTIES 3.1 All livestock are sold: * “As is” * “With all faults” 3.2 The Platform makes NO warranties regarding: * Health status * Disease-free status * Fitness for purpose * Compliance with veterinary standards 3.3 Any representations must be made solely by the Seller. --- 4. DISEASE RISK 4.1 Livestock may carry: * Infectious diseases * Parasites * Undiagnosed conditions 4.2 Buyers acknowledge that: * Disease may not be detectable at time of sale * Symptoms may develop after transfer 4.3 The Platform is not liable for: * Disease transmission * Outbreaks * Post-sale illness --- 5. BIOSECURITY RESPONSIBILITY 5.1 Users are responsible for: * Implementing biosecurity measures * Quarantine procedures * Veterinary testing 5.2 Buyers must: * Isolate new animals where appropriate * Conduct health inspections 5.3 Sellers must: * Disclose known health issues * Comply with applicable regulations --- 6. VETERINARY SERVICES 6.1 The Platform does NOT provide: * Veterinary advice * Health assessments * Certification 6.2 Users must obtain independent veterinary advice. --- 7. TRANSPORT-RELATED HEALTH RISKS 7.1 Transport may increase risks of: * Stress * Injury * Disease transmission 7.2 The Platform is not liable for: * Health deterioration during transport * Death or injury in transit --- 8. REGULATORY COMPLIANCE 8.1 Users must comply with all applicable laws, including: * Animal Diseases Act * Animal Protection Act * Veterinary regulations * Movement control regulations 8.2 The Platform is not responsible for: * Legal non-compliance * Failure to obtain permits * Breach of quarantine rules --- 9. OUTBREAKS AND GOVERNMENT ACTION 9.1 In the event of: * Disease outbreaks * Government-imposed restrictions The Platform is not liable for: * Loss of livestock * Movement restrictions * Financial losses --- 10. BUYER ACKNOWLEDGEMENT 10.1 By purchasing livestock, the Buyer acknowledges: * Inherent biological risks * Uncertainty of animal health outcomes 10.2 The Buyer assumes full responsibility after transfer of risk. --- 11. LIMITATION OF LIABILITY 11.1 To the maximum extent permitted by law, the Platform shall NOT be liable for: * Disease-related losses * Veterinary costs * Livestock mortality * Indirect or consequential damages --- 12. INDEMNITY 12.1 Users indemnify NEXT GENETICS DORPERS (PTY) LTD against: * Animal health claims * Disease transmission claims * Regulatory penalties * Third-party claims --- 13. RECORDS AND DISCLOSURE 13.1 The Platform may store: * Listings * Communications * Transaction records 13.2 These may be used in: * Dispute resolution * Legal proceedings --- 14. AMENDMENTS 14.1 This Disclaimer may be updated at any time. 14.2 Continued use of the Platform constitutes acceptance of changes. --- 15.
